Boeing Co. and US prosecutors said they’re working to hammer out a new deal to settle a criminal case stemming from two fatal 737 Max crashes after a federal judge blocked an earlier plan because it included race as a factor for selecting a compliance monitor.

The U.S. Justice Department and Boeing told a court on Friday they have not reached agreement on a revised plea deal after a U.S. judge in December rejected the deal, faulting a diversity and inclusion provision.

The Justice Department reached a deal with Fulton County to improve conditions at the jail. The DOJ says it found life-threatening conditions at the Fulton County Jail that violated the constitutional rights of inmates.
